Court dismisses injunction application against DVLA

An Accra Human Rights Court has dismissed an Interlocutory injunction seeking to stop the Driver and Vehicle Licensing Authority, DVLA, from registering some new STC buses without emergency exit units.

The presiding judge, Justice Anthony Yeboah, held that on the balance of convenience, the applicant, one Kwabena Osei will not suffer any damage if the application is granted as compared to the State transporter. 

Mr Osei filed the suit for an interim order to prevent the DVLA from registering a fleet of buses that have been imported into the country by the State Transport Company.

The plaintiff already has a pending suit before the Court against the DVLA, the police and nine others for their failure to enforce the law on the use of emergency exits on commercial vehicles. 

He is praying the court to compel the DVLA and the police to apply the law on emergency exit doors contending that under the law,   commercial buses are supposed to have at least two entrances, one of which should be an emergency exit approved by the licensing Authority. 

Mr Osei also claims that the police has neglected its mandate of sanctioning such offending vehicle operators and vehicles.
